§ 1. General Provisions

These Terms and Conditions define the rules for using the online store available at: https://sklep.karbonit.pl.

Contact with the Seller is possible via the contact form available on the website.

These Terms and Conditions apply to both Consumers and business customers using the Store.

Placing an order requires reading and accepting these Terms and Conditions.

The Seller complies with personal data protection regulations in accordance with the GDPR.
§ 2. Definitions

Store – the online store available at https://sklep.karbonit.pl.
-
Seller – Piotr Popławski KARBONIT.
-
Customer – any natural person, legal person, or organizational unit placing an order.
-
Consumer – a natural person making a purchase not directly related to their business activity.
-
Entrepreneur with consumer rights – a sole proprietor making a purchase not directly related to their business activity.
-
Goods – products offered in the Store.
-
Sales Agreement – a distance contract concluded between the Customer and the Seller.

Order – a declaration of intent submitted by the Customer to conclude a Sales Agreement.
-
Customer Account – an individual panel available after registration.
-
Business Days – Monday to Friday, excluding public holidays.
§ 3. Product Information and Prices

All prices displayed in the Store are gross prices (including VAT).

Prices do not include delivery costs, which are shown separately during the ordering process.

Product information does not constitute an offer within the meaning of the Civil Code but an invitation to conclude a contract.

The Seller reserves the right to change prices; however, such changes do not affect orders already placed.
§ 4. Placing Orders

Orders may be placed 24/7 via the Store’s website.

The Customer selects the Goods, adds them to the cart, and proceeds through the ordering process.

Providing accurate data is required for order fulfillment.
-
After placing an order, the Customer receives an email confirmation.
-
The Sales Agreement is considered concluded once the Seller confirms the order.
§ 5. Payments

The Customer may choose one of the following payment methods:

traditional bank transfer,

cash on delivery,
-
online payment (e.g., Przelewy24, PayU – to be completed),

BLIK (if available).

For bank transfer payments, the Customer has 7 days to make the payment.

Failure to pay within the specified period results in order cancellation.
§ 6. Delivery

Delivery is available within Poland (optionally: and the EU).

Available delivery methods include:

courier service,
-
InPost parcel lockers,
-
personal collection (if available).
-

Delivery costs are displayed during the ordering process.
-
The standard order processing time is 1–3 business days unless the product description states otherwise.
§ 7. Right of Withdrawal (Returns)

A Consumer has the right to withdraw from the contract within 14 days without giving any reason.

To exercise the right of withdrawal, the Customer must send a declaration to the Seller’s email or postal address.
-
The Customer returns the Goods at their own expense to the Seller’s address.
-
Refunds are issued within 14 days of receiving the withdrawal declaration, but not earlier than upon receipt of the returned Goods.

The right of withdrawal does not apply in cases specified in Article 38 of the Consumer Rights Act, including:

goods made to the Customer’s specifications,
-
goods showing signs of use,
-
audio/video recordings after opening the packaging.

§ 8. Complaints (Warranty)

The Seller is liable for defects in the Goods in accordance with the Civil Code.

Complaints may be submitted via the contact form or email.
-
A complaint should include:

name and surname,
-
order number,
-
description of the defect,
-
photos (if possible).

Complaints are reviewed within 14 days.
-
The Customer may request:
-
repair,
-
replacement,
-
price reduction,
-
withdrawal from the contract (if the defect is significant).

§ 9. Guarantee

Goods may be covered by a manufacturer’s guarantee.

Information about the guarantee is provided in the product description.
-
Guarantee claims are handled according to the manufacturer’s terms.
§ 10. Personal Data Protection (GDPR)

The Seller is the controller of personal data.

Data is processed for the purpose of order fulfillment, account management, and communication with the Customer.

The Customer has the right to:

access their data,

rectify it,
-
delete it,
-
restrict processing,
-
transfer data.

§ 11. Final Provisions

These Terms and Conditions are governed by Polish law.

In matters not regulated herein, the provisions of the Civil Code and the Consumer Rights Act apply.

The Seller reserves the right to amend the Terms and Conditions.

Amendments take effect upon publication on the Store’s website.
-
Disputes may be resolved amicably or before a court competent for the Seller.
